The O-1B Visa has a category that is not found in either the O-1A or the EB1, and allows you to show your achievements based on ‘Significant Recognition from Organizations, Critics and Experts’. As with our other categories, the first step is to look at the precise wording of the category, which reads: –

Significant recognition for achievements from organizations, critics, government agencies or other recognized experts in the field in which the alien is engaged. Such testimonials must be in a form that clearly indicates the author’s authority, expertise, and knowledge of the alien’s achievements;

For this category, you can show evidence of your achievements by getting letters from recognized industry experts that attest to your skills and impact in the industry. With authors who are recognized experts, these letters carry a certain amount of weight with US immigration – when they are properly written. Immigration does not explicilty tells us how many letters are sufficient, and this is where we can help.With these letters, more is not necessarily better as the letters need to carefully written to ensure that US Immigration has the information they need to evaluate your talents. By working carefully with us to get the letters drafted, we can help to ensure that the letters are written in a manner that will carry weight with US Immigration.

We recommend that clients begin working with us before they get their letters signed as it takes experience and knowledge to write the letters correctly. When we start a case with already signed letters, we often re-draft them anyway, and it can put you in the awkward position of seeking a new signature, and this can frustrate all parties involved.

While these types of letters can satisfy a category for the O-1B application, we have to be careful that your entire case does not rely too heavily upon information in letters. Such cases often fail, which is why we will work with you to carefully prepare a case that includes letters, as well as other, more objective, evidence.

O-1B Visa Significant Recognition Commentary:

If you have any press coverage where critics have recognized you with critical acclaim then one such article is worth any five peer letters we might be able to submit, let alone if you have multiple press articles specifically showering you with praise. For some aliens, we may only have letters for this category – that’s ok, but I’d be looking very closely at the strength of the other categories to make sure that, overall, the case was well balanced.

Some professionals work for government agencies, and letters of praise confirming excellent work is highly valuable because government agencies are like the press. The alien has very little influence over what the government agency might say. However, since many aliens will solicit letters from their peers with whom they worked within a government agency to draft the letters, the status and impact of a government letter of support is highly significant. In essence whatever a government agency puts on its letterhead is deemed factually accurate more so than what a buddy writes for his alien O1 visa applicant buddy.
